Terms of Service

These terms cover your use of GrowDraft: the garden planner, the website and the mobile app. GrowDraft is a product of Vegardi Inc. GrowDraft is provided by Vegardi Inc., a company with its registered address at 200 South Biscayne Boulevard, STE 4100, Miami, FL 33131, United States ("we", "us"). You can reach us at [email protected].

By using GrowDraft you agree to these terms. If you do not agree, please do not use it. How we handle your personal information is explained in our Privacy Policy, which is a separate document.

GrowDraft is in early access. Features change often, and some are still being built. We try to label anything that is not ready yet as "coming soon".

You can open the planner and use it without an account. Your garden saves in your browser on that device. A free account adds cloud saving, sync across devices, read-only share links and a larger daily allowance for yard scans, sketch reading and photo renders.

GrowDraft is not directed at children under 13.

Keep your password to yourself and tell us if you think someone else has used your account. You are responsible for what happens in your account unless it was used without your permission and you could not have prevented it.

GrowDraft is a free beta. Paid plans are not currently offered. We do not ask for payment details. Yard scans, sketch reading and photo renders share a daily allowance. When it runs out, the rest of the planner keeps working and the allowance resets the next day.

We may offer paid features or paid printables in the future. Before you pay for anything, we will show you the price, what you get and any cancellation or refund rights, and you will have to agree to that separately.

Your gardens, plans, sketches and photos belong to you. We do not claim ownership of anything you make or upload.

To run GrowDraft we need your permission to store, copy, process and display that content. You give us that permission for as long as it is needed to provide the service to you: for example, to save your garden to the cloud, to read a sketch or a yard photo, to render a picture of your design, or to show a plan to the people you send a share link to.

A share link lets anyone who has it view that garden. Only share it with people you are happy to show.

Please only upload photos and sketches you have the right to use. Avoid photos that show other people or private details you do not want processed. When you choose a yard scan, sketch reading or photo render, your image is sent to an outside image-processing service to produce the result. The Privacy Policy explains which one and what is kept.

Please use GrowDraft the way it is meant to be used. In particular, do not:

• break the law, or upload content that is illegal, hateful or that infringes someone else's rights;
• try to get around the daily allowance, for example by creating many accounts or running scripts;
• scrape, copy or resell the plant catalogue, the 3D models or other parts of the service;
• try to break into, overload or interfere with GrowDraft, its servers or other people's accounts;
• take apart or copy the app's code, except where the law allows it.

The GrowDraft name, the app, its code, its design, the plant and product catalogue and the 3D models belong to us or to the people who license them to us. You may use them inside GrowDraft and print or share the plans you make. You may not copy them for other purposes.

If you send us ideas or feedback, we may use them to improve GrowDraft without owing you anything.

Generated images and photo-derived dimensions are estimates, not construction drawings.

GrowDraft helps you plan. It does not replace a site survey, a builder, an electrician or a structural engineer. Measurements from photos, sketches and satellite maps, sun and shade hours, sizes of plants and trees, balcony load limits and power budgets are all estimates. Photo renders show an idea of the finished look, not exactly how it will turn out.

Before you build, dig or buy, check the measurements on site. Ask a qualified professional about anything structural, electrical, involving water or gas, or near property lines and underground pipes and cables. Check whether you need a permit or your landlord's or building's permission.

GrowDraft gives general gardening information: sowing and frost dates, planting suggestions, companion ideas, care tips and the symptom guide. It is written for gardens in general, not for your garden in particular. Local weather, soil, pests and plant varieties can make a real difference, so results are not guaranteed. A crop can fail even if you follow every tip.

The symptom guide is a starting point. When a symptom has more than one possible cause, it says so instead of guessing. If a plant problem matters to you, ask a local garden centre or an agricultural extension service.

Some plants are poisonous to people or pets, or irritate the skin, and some look like plants that are safe to eat. Never eat a plant, berry or mushroom because of something GrowDraft showed you unless you are sure what it is. Keep children and animals away from plants that may harm them. If someone may have swallowed something poisonous, contact a poison centre or emergency services straight away.

If you use fertiliser, pest control or any garden chemical, follow the label and your local rules. GrowDraft does not tell you which chemical products are safe in your situation.

Some structures, equipment and seeds in GrowDraft link to other stores. Some of those links are affiliate links, which means we may earn a small commission if you buy something. It does not change the price you pay.

We are not the seller of products in other stores. Your purchase is between you and that store, under its terms, prices and returns policy. Prices and stock we show may be out of date, so check the details on the store's page before you buy.

Confirm measurements, installation requirements, product details, availability and final prices with the store before buying. Product links may lead to partner stores.

Free printables from our shop are for your own personal use. Please do not resell or republish them.

GrowDraft uses data from other organisations, including satellite and map imagery, building outlines, address search, weather forecasts, long-term climate records for frost dates, and product and seed details from suppliers. This data can be incomplete, out of date or temporarily unavailable, and we cannot always fix it. Some of these services have their own terms, which apply when you use them through GrowDraft.

GrowDraft is a sister product of Vegardi, a grow app. Where GrowDraft lets you sign in with a Vegardi account, the account itself is a Vegardi account and Vegardi's own terms and privacy policy also apply to it.

We work to keep GrowDraft running and your saved gardens safe, but we cannot promise it will always be available or free of errors, especially during early access. We may change, pause or remove features. If we plan to close GrowDraft, or remove something that holds your saved work, we will give you reasonable notice and a way to export it first.

Without an account, your garden lives only in this browser on this device. Clearing your browser data, or switching browser or device, removes it. You can export a project file at any time, with or without an account. For gardens that matter to you, keep an exported copy.

You can stop using GrowDraft whenever you like. To delete your account and the data we keep for it, email [email protected]. Files you have already exported stay yours.

We may suspend or close an account if it seriously or repeatedly breaks these terms, if the law requires it, or to protect other users or the service. Unless there is an urgent reason, such as fraud or a security risk, we will tell you first, explain why and give you a chance to save your work.

GrowDraft is provided as it is, for planning. If you live in a country with consumer protection laws, you have legal rights that these terms cannot take away. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

Apart from that, we are responsible for loss you suffer that was a foreseeable result of us breaking these terms or failing to take reasonable care. We are not responsible for loss that nobody could have foreseen, for loss caused by things outside our reasonable control, or for business losses, because GrowDraft is meant for personal use.

In particular, we are not responsible for building work, purchases, crops or plant choices you decide on based on an estimate or a general tip, where you did not check it as these terms ask you to.

Where the law allows a limit, our total liability to you is limited to the greater of what you paid us in the 12 months before the claim and [Liability cap amount].

We may update these terms as GrowDraft changes or the law changes. We will change the date at the top of this page. If a change matters for you, for example one that affects your rights or what you pay, we will tell you in the app or by email before it takes effect. If you do not agree with a change, you can stop using GrowDraft and ask us to delete your account.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules, and you and Vegardi Inc. submit to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida for any dispute arising out of them.

If something goes wrong, please email us first. Most problems can be sorted out that way.

If any part of these terms turns out to be invalid, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.
